209A and Domestic Restraining Orders
There is nothing more important than your safety and the safety of your loved ones.  If you are in fear of imminent serious physical harm, don't leave anything to chance.  We have helped several clients protect themselves and their families from those who have threatened their safety by obtaining the appropriate restraining orders, and making sure that those orders are extended.  

On the other hand, being falsely accused of threatening or abusing someone can have terrible consequences, including leaving a permanent mark on your criminal record, placing you in danger of being accused of the crime of violating a restraining order, and ultimately endangering your freedom.  If a restraining order has been obtained against you based on false allegations, we have the experience and knowledge to help.

Real Estate Purchases, Sales & Leases

Wills, Trusts & Estate Planning
Estate Planning is the area of law that consists of planning and structuring the client’s estate to reflect their assets and liabilities and how they relate to the present and future desires and needs of the clients, family and friends. We accomplish this service at Stevenson & Lynch, P.C. by first interviewing the client and discovering the extent of their assets and liabilities. We determine to whom the client would like to distribute the assets and exactly how they should be received. We prepare the documents that appoint the various fiduciaries, such as executor or guardian, and also protect the estate from unnecessary taxes.

As a part of the overall Estate Planning service we prepare a Last Will and Testament for each individual.  In the Will we may specify the order of distribution, who is the executor and guardian, waive surety on the executor’s bond (saves on the expenses to the estate), grant far reaching powers to the fiduciaries, if necessary, and even disinherit certain parties. The Will can also guide the fiduciaries in the distribution of assets even if the distribution nominally occurs outside of the will, such as a named beneficiary of a life insurance policy who has passed away.

There are two other documents that are essential to the success of an estate plan. The first controls the handling of property and financial matters by giving the power to permit someone else stand in one’s stead, a Durable Power of Attorney. This is a very powerful document and only a very trustworthy individual should be considered for this position. The document is written so that the transfer of power will withstand the disability of the donor. The second document, a Health Care Proxy, allows another person to make decisions regarding the health care of the donor, especially when the decision involves the continuation of death delaying medical procedures in what would otherwise be a terminal and irreversible condition.

The final aspect of the Estate Planning process is the determination of whether a trust will provide further benefit to the client’s estate. There are many different and varied types of trusts. Each one is dependent upon the particular circumstances of the individual client. An examination of those circumstances in light of the full informational interview will determine the need and, if necessary or desired, the type of trust that provides the best solution for the client. The most common trust used at Stevenson & Lynch, P.C. is one called an A-B Trust or Family Trust/Credit Shelter Trust. This trust maximizes the amount available for future distribution to the children and surviving spouse and minimizes the estate tax burden.

The practice of elder law is different from most other areas of law. The field encompasses broad disability issues as well as estate planning ones. The practice is multidisciplinary in its perspective and demands a working knowledge across several further areas of law. 

Here at Stevenson & Lynch, P.C. our approach is to use the in house expertise of our Partners and Associates, as well as a network of outside professionals to provide a full service response to issues arising from a long life. We respect the client’s concerns over health, isolation and financial problems and we integrate the legal planning into the larger picture of personal planning. In addition to the customary tools of estate planning such as Durable Powers of Attorney, Health Care Proxies, Wills and Trusts, we also explore the issues of housing, long term care, non-traditional financial options and other age and independence solutions.
